These Terms of Service ("Terms") govern your use of @GabbyEnglishTutorBot, the related website, and the Telegram Mini App (together, the "Service"), operated by Dmitry, Ukraine ("we", "us", or "our").
By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What the Service is
The Service is an AI-powered English tutoring product designed to help users practice spoken and written English in Telegram and related interfaces.
The Service may provide AI-generated replies, corrections, explanations, transcription, speech features, and related learning tools.
2. Eligibility
You may use the Service only if you can legally agree to these Terms under the laws that apply to you.
If you are under the age at which you can legally enter into this agreement on your own, you may use the Service only with permission and involvement from a parent or legal guardian.
3. Educational purpose only
The Service is provided for language learning and practice purposes only.
We do not guarantee any particular learning outcome, exam result, fluency level, or improvement speed.
The Service is not a substitute for professional educational, legal, medical, psychological, or other professional advice.
4. AI-generated content
Some parts of the Service rely on artificial intelligence.
AI-generated outputs may sometimes be inaccurate, incomplete, delayed, or inappropriate for your specific situation. You are responsible for reviewing and using your judgment before relying on any output.
You understand that the Service may generate different answers to similar inputs and that results are not guaranteed to be error-free.
5. Accounts and Telegram use
The Service is accessed through Telegram and related tools.
You are responsible for your own Telegram account, device, and access to the Service.
Your use of Telegram and any third-party platform is also subject to that platform's own terms and policies.
6. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for unlawful, harmful, abusive, fraudulent, or deceptive purposes
- harass, threaten, or impersonate other people
- interfere with or disrupt the Service or its infrastructure
- attempt to gain unauthorized access to systems, accounts, or data
- use bots, scripts, or automated methods to abuse the Service
- copy, reverse engineer, scrape, or resell the Service except where applicable law does not allow restrictions
- use the Service to generate or distribute unlawful, infringing, or abusive content
We may suspend or terminate access if we believe you violate these Terms or misuse the Service.
7. User content
You may provide text, voice input, and other content through the Service ("User Content").
You keep ownership of your User Content.
However, you give us a limited, non-exclusive license to use, process, transmit, store, and analyze User Content as necessary to operate, secure, maintain, and improve the Service, as described in our Privacy Policy.
You are responsible for making sure that your User Content does not violate any law or the rights of others.
8. Subscriptions, billing, and payments
Some features of the Service may require a paid subscription.
Prices, billing intervals, and included features will be shown to you before purchase.
Payments and subscription transactions may be processed by Paddle or another authorized payment provider.
If your subscription renews automatically, it will continue until you cancel it.
You are responsible for any taxes, fees, or charges associated with your purchase except where the payment provider handles them as merchant of record.
9. Cancellations and refunds
You can cancel future subscription renewals at any time through the payment or subscription management method made available to you.
If Paddle is the payment provider for your purchase, subscription management and refund requests may be handled through Paddle's receipt links, billing page, or support flow.
Refunds, withdrawals, and cancellations are subject to the payment provider's processes, the plan terms shown at checkout, and any mandatory rights you may have under applicable consumer law.
Nothing in these Terms limits any non-waivable consumer rights that apply to you.
10. Availability and changes
We may update, modify, suspend, or discontinue any part of the Service at any time, with or without notice.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
Features may change over time, including AI models, voice features, pricing, limits, and availability.
11. Privacy
Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect personal data.
12. Intellectual property
The Service, including its software, design, branding, text, graphics, and other non-user content, is owned by us or our licensors and is protected by applicable intellectual property laws.
Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, sublicense, or create derivative works from the Service.
13. Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.
We do not guarantee that the Service will meet your expectations or that any content generated by the Service will be accurate, complete, or suitable for your needs.
14. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or opportunities arising from or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us for the Service during the 12 months before the event giving rise to the claim, or 50 EUR if you have not made any payment, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.
15. Termination
You may stop using the Service at any time.
We may suspend or terminate your access at any time if we reasonably believe that:
- you violated these Terms
- your use creates risk for us, other users, or third parties
- we are required to do so by law or by a platform/provider we rely on
- continuing to provide the Service is no longer commercially or technically feasible
Sections that by their nature should survive termination will continue to apply, including sections on payments already due, intellectual property, disclaimers, limitation of liability, and dispute-related terms.
16. Governing law
These Terms are governed by the laws of Ukraine, except to the extent that mandatory consumer protection laws in your country of residence apply and cannot be excluded.
17. Disputes
If you have a problem with the Service, please contact us first at gabbyenglishtutor@gmail.com and we will try to resolve it informally.
If a dispute cannot be resolved informally, it will be handled by the courts having jurisdiction under applicable law, subject to any mandatory rights you may have as a consumer.
18. Changes to these Terms
We may update these Terms from time to time.
When we do, we will post the updated version and change the "Last updated" date above. By continuing to use the Service after the updated Terms take effect, you agree to the revised Terms.
